1. SPONSOR
1.1. The Sponsor is Julia Toivonen trading as L’il Aussie Prems (ABN 67 813 298 386) a business registered in the State of Victoria (“Sponsor”).
1.2. The Sponsor is engaged in offering free support to families of premature babies throughout Australia.
1.3. The Sponsor together with a small community group will sponsor Australia’s first award to recognize and celebrate the dedication of individual volunteers within the premature baby community.
1.4. The Sponsor will:
(a) supply the administrative, marketing and promotional functions of the award; and
(b) finance the prize money for the award,
on the condition that the applicants are prepared to give certain undertakings to the Sponsor pursuant to the Terms & Conditions of Entry.
2. ELIGIBILITY
2.1. The 2010 Local Premmie Hero Recognition Award (“Award”) is:
(a) only open to individuals (i.e. not corporate bodies) over the age of ten (10) years or more; and
(b) not open to individuals who are selected as part of the Committee (as defined below in paragraph 6.1 of these terms).
2.2. Eligibility for the Award is limited to Australian citizens or permanent residents who have been resident in Australia for at least three (3) years prior to the closing date of the call for nominations and have performed the major contributions whilst living in Australia.
2.3. Notwithstanding 2.2, the winner of the Award from the preceding year is not eligible for nomination or to be selected for the Award. For clarity purposes, the first and second runner up from the preceding year is eligible for nomination and selection for the Award.
2.4. Nomination by an individual, group or an associate is preferred; however, self-nomination will be accepted where the nomination is supported by strong references.
2.5. For the purpose of clarity, nothing in these terms limit an Individual who volunteers for L’il Aussie Prems from being nominated and/or selected as for the Award.
3. ACCEPTING THE TERMS
Participation in this promotion is deemed acceptance of these Terms & Conditions of Entry.
4. LIMITATIONS ON ENTRY
4.1. Participants may only enter the competition once.
4.2. Only the first received entry will be valid if more than one entry is received from a participant.
5. HOW TO ENTER
5.1. Applications for nominations open on Monday 1st February 2010
5.2. Applications for nominations close on Friday 30th April 2010 at 12.59pm
5.3. To enter, complete the nomination form online
5.4. Each nomination must include the following details:
(a) Details of the nominee’s achievements;
(b) Any third party references applicable to the nomination;
(c) The contact details of the person nominating and the nominee; and
(d) A declaration that all information submitted on the nomination form must be true and correct at the time of submitting the nomination.
6. SELECTION OF WINNERS
6.1. This is a game of skill; chance plays no part in determining the winner. The competition will be judged by a committee appointed by the Sponsor (“Committee”) based on the merits of the nomination pursuant to clause 5.4.
6.2. The Sponsor will select a Committee from members of the premature baby community and/or other relevant backgrounds.
6.3. If the winner of the prize is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or legal guardian.
6.4. The selection made by the Committee is final and conclusive and no correspondence will be entered into after the selection has been made.
6.5. The Sponsor and the Committee reserve the right not to make an award in any year.
6.6. The Sponsor and the Committee reserve the right to change and/or vary an award in any year.
6.7. The Sponsor and the Committee may contract an applicant or nominee at any time after receiving an entry for the purpose of determining whether the nominee meets the eligibility requirements.
6.8. The Sponsor and the Committee reserve the right to declare a finalist ineligible if, in the reasonable opinion of the Sponsor or Committee the nominee is unable to represent the Award in a satisfactory manner, or a conflict of interest exists or arises.
6.9. The Committee reserves the right to verify the validity of applicants and nominees (including but not limited to any applicant’s identity, age, place of residence) and to disqualify any applicant for tampering with the entry process or for submitting an entry which is not in accordance with these Terms and Conditions of Entry. Failure by the Committee to enforce any of its rights at any stage does not constitute a waiver of those rights.
7. PRIZE
7.1. A prize will be given to the winner of the Award. The prize will include:
(a) A RedBalloon gift certificate to the value of $500.00;
(b) Two movie tickets to their cinema of choice (to the value of $75.00);
(c) A uniquely designed trophy and framed certificate and;
(d) Their story featured on the L’il Aussie Prems website and newsletter.
7.2. A prize will be given to the first runner up of the Award. The prize will include:
(a) A RedBalloon gift certificate to the value of $250.00;
(b) A beautiful flower arrangement (to the value of $55.00);
(c) A uniquely designed medal and framed certificate and;
(d) Their story featured on the L’il Aussie Prems website and newsletter.
7.3. A prize will be given to the second runner up of the Award. The prize will include:
(a) A RedBalloon gift certificate to the value of $150.00;
(b) A beautiful flower arrangement (to the value of $55.00)
(c) A uniquely designed medal and framed certificate and;
(d) Their story featured on the L’il Aussie Prems website and newsletter.
7.4. The prize must be taken as offered.
7.5. If the prizes remain unclaimed after a period of 30 days after the date of notification of the winner, the prizes may be forfeited and used by the Committee at the discretion of the Committee.
7.6. Photographic identification of the winner will be required (examples include drivers licence/passport/student card where photo included) to claim the prize. In special situations, and subject to the absolute discretion of the Committee, a winner up may nominate a designated representative to collect the prize. The representative will be required to present written authorisation from the winner and photographic identification of both the winner and their representative. Photographs will not be returned.
7.7. The winner, first and second runner up, nominee and nominator agrees to undertake all reasonable media and promotional activities as directed by the Sponsor. In accepting these terms and conditions, you accept that you may be filmed and photographed and may be required to undertake television, radio, print and/or online media interviews and appearances and that those films, photographs and/or interviews may be in all forms of media, including but not limited to, television, radio, print and other media.
8. NOTIFICATION OF WINNERS
8.1. It is anticipated that the winner will be notified by telephone.
8.2. The Awards will be officially announced on the L’il Aussie Prems website in May 2010.
9. ENTRIES
9.1. All entries become the property of the Committee.
9.2. Entries not completed in accordance with the Terms & Conditions of Entry or received after the closing date will not be considered.
9.3. Indecipherable or incomplete entries will be disregarded.
9.4. No responsibility is taken for late or misdirected email.
10. RESERVATION
10.1 The Committee reserves the right to nominate an appropriate candidate who has not been nominated through the nomination process.
11. PRIVACY & CONFIDENTIALITY
11.1. The Committee is an independent panel of representatives from the community and they undertake to maintain confidentiality of all applicants and nominees prior to participating in the judging process.
11.2. The personal information collected as part of the entry is collected to enable identification of the winner and for future marketing and promotional purposes. Such information will only be disclosed to the Committee and its related bodies corporate for these purposes.
11.3. Applicants and nominees may contact the Committee if they would like details of the personal information that the Committee may hold about the applicant or nominee or if they would like it to be corrected.

12. LIMITATION OF LIABILITY
12.1. Except for any liability that cannot be excluded by law, the Committee (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition, including, but not limited to, where arising out of the following:
(a) any technical difficulties or equipment malfunction (whether or not under the Sponsor’s or the Committee’s control);
(b) any theft, unauthorised access or third party interference;
(c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Committee) due to any reason beyond the reasonable control of the Committee;
(d) any variation in prize value to that stated in these Terms & Conditions of Entry;
(e) any tax liability incurred by a winner or entrant; and/or
(f) redemption of the prize.
12.2. If for any reason the competition does not run for its duration due to a computer virus, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Sponsor or the Committee that corrupts or affects the administration, security, fairness, integrity or proper conduct of the competition, the Sponsor and the Committee reserve the right in their sole discretion to cancel, terminate, modify or suspend the competition or disqualify any individual who tampers with the entry process.
13. INTERPRETATION
13.1 In these Terms & Conditions of Entry, subject to any express or implied contrary intention:
13.1.1 reference to a party includes a reference to its personal representatives, successors and assigns;
13.1.2 words importing the singular include the plural and vice versa;
13.1.3 words importing any gender include every gender; and
13.1.4 clause headings are inserted for convenience of reference only and do not affect the interpretation or construction of this agreement.
13.1. These Terms & Conditions of Entry shall be governed and construed in accordance with the laws of Victoria.
14. GOVERNING LAW
14.1. These Terms & Conditions of Entry are governed by the laws of Victoria, Australia.
14.2. If any part of these Terms & Conditions of Entry is found to be invalid or unenforceable, it shall be severed to the extent possible without affecting the remainder.
15. INDEPENDENT LEGAL ADVICE
15.1. You agree that you have obtained independent legal advice for any conditions which you do not fully understand.
