Terms and Conditions of Entry


1. SPONSOR

1.1. The Sponsor is L’il Aussie Prems Foundation Incorporated (ABN 42 701 326 952) a charity registered with the Australian Charities & Not for profits Commission and incorporated in the State of Victoria (“Sponsor”).

1.2. The Sponsor is engaged in offering support to families of premature babies throughout Australia.

1.3. The Sponsor together with a small community group will sponsor Australia’s first award to recognise and celebrate the dedication of individual volunteers within the premature baby community.

1.4. The Sponsor will:

(a) supply the administrative, marketing and promotional functions of the award; and

(b) finance the prize money for the award,

on the condition that the applicants are prepared to give certain undertakings to the Sponsor pursuant to the Terms & Conditions of Entry.

2. ELIGIBILITY

2.1. The 2015 Premmie Hero Volunteer Awards (Award) is:

(a)  only open to individuals (i.e. not corporate bodies or groups) over the age of ten (10) years or more; and

(b) not open to individuals who are selected as part of the Selection Panel in that calendar year (as defined below in paragraph 6.1 of these terms).

2.2. Eligibility for the Award is limited to Australian citizens or permanent residents who have been resident in Australia for at least three (3) years prior to the closing date of the call for nominations and have performed the major contributions whilst living in Australia.

2.3. Notwithstanding 2.2, the winner of the Award from the preceding year is not eligible for nomination or to be selected for the Award. For clarity purposes, the first and second runner up from the preceding year is eligible for nomination and selection for the Award.

2.4. Executive and General Committee Members of L’il Aussie Prems Foundation Inc are ineligible for nomination for an Award whilst holding an appointed position. Nothwithstanding this clause, Committee Members of L’il Aussie Prems Foundation Inc shall be entitled to receive a copy of the nominations received by the Selection Panel.

2.5.  The Award is an award for volunteers. A person is ineligible for nomination if that person performs paid work solely focused in the premature baby community, whether as an employee, medical professional or otherwise of a charity or other organisation. If a person voluntarily provides services or volunteers on a personal level outside of their paid employment and is of significant benefit to the community, they may be eligible. Nominations are ineligible should a nominee’s role be that of a parents general responsibilities. The determination as to whether a potential nominee is disqualified under this clause shall be made by either the Selection Panel or the Sponsor and their decision shall be final.

2.6. Individuals who:

(a) have financially contributed to the awards personally; or

(b) who are officeholders or controllers of a business or organisation which has financially contributed to the awards;

are ineligible for nomination for the Award for a period of 3 years from the date of their financial contribution.

2.7. Nomination by an individual, group or an associate is preferred; however, self-nomination will be accepted where the nomination is supported by strong references.

2.8. An individual who volunteers for L’il Aussie Prems Foundation Incorporated is eligible for nomination and/or selection for the Award unless they are otherwise made ineligible by these Terms & Conditions.

3. ACCEPTING THE TERMS

Participation in this promotion is deemed acceptance of these Terms & Conditions of Entry. Participation includes accepting or making a self-nomination for an Award.

4. LIMITATIONS ON ENTRY

4.1. Participants may only enter the competition once.

4.2. Only the first received entry will be valid if more than one entry is received from a participant.

5. HOW TO ENTER

5.1. Applications for nominations open on Wednesday, 1st July 2015 (9.00am AEST)

5.2. Applications for nominations close on Monday, 31st August 2015 (11.59pm AEST)

5.3. To enter, complete the nomination form online

5.4. Each nomination must include the following details:

(a)  Details of the nominee’s achievements;

(b)  Any third party references applicable to the nomination;

(c)  The contact details of the person nominating and the nominee; and

(d) A declaration that all information submitted on the nomination form must be true and correct at the time of submitting the nomination.

5.5. Where a person has been nominated by another person, the nominee’s entry will be made upon their acceptance of the nomination.  The Selection Panel and/or Sponsor of the award will contact nominees in this regard.

(a) Where a person has been nominated multiple times by more than one person, the Sponsor and/or the Selection Panel reserve the right combine the information provided by each nomination for the purpose of judging of the awards.

6. SELECTION OF WINNERS

6.1. This is a game of skill; chance plays no part in determining the winner. The competition will be judged by a Selection Panel appointed by the Sponsor (“Selection Panel”) based on the merits of the nomination pursuant to clause 5.4.

(a) Judging of the Awards is not based on the number of nominations received.

(b) Nominations are not open to public voting. 

6.2. The Sponsor will select a person from members of the premature baby community and/or other relevant backgrounds. Individuals or representatives of businesses who have financially contributed to the event may be appointed as members of the Selection Panel.  One (“Committee Member”) of L’il Aussie Prems Foundation Inc shall sit on the Selection Panel each year. If a person appointed on the Selection Panel is under 18 years of age, the Sponsor must receive written permission from a parent or legal guardian accepting their participation on the Selection Panel.

(a) The Sponsor reserves the right to appoint an additional judge to the Selection Panel at anytime should there be a hung vote or to avoid a conflict of interest arising during the judging process of the awards. The selection made by the Sponsor is final and conclusive and no correspondence will be entered into after the selection has been made.

6.3. If the winner of the prize is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or legal guardian.

6.4. The selection made by the Selection Panel is final and conclusive and no correspondence will be entered into after the selection has been made.

6.5. The Sponsor and/or the Selection Panel reserve the right not to make an award in any year.

(a) The Sponsor and/or the Selection Panel reserve the right to change and/or vary an award in any year.

6.6. The Sponsor and/or the Selection Panel may contact an applicant or nominee at any time after receiving an entry for the purpose of determining whether the nominee meets the eligibility requirements.

6.7. The Sponsor and/or the Selection Panel reserve the right to declare a finalist ineligible if, in the reasonable opinion of the Sponsor or Selection Panel, the nominee is unable to represent the Award in a satisfactory manner, or a conflict of interest exists or arises.

6.8. The Selection Panel reserves the right to verify the validity of applicants and nominees (including but not limited to any applicant’s identity, age, place of residence) and to disqualify any applicant for tampering with the entry process or for submitting an entry which is not in accordance with these Terms and Conditions of Entry. Failure by the Selection Panel to enforce any of its rights at any stage does not constitute a waiver of those rights.

6.9. WHERE A CONFLICT OF INTEREST MAY ARISE

(a) Any person appointed to the Selection Panel must disclose any affiliation whether personal or professional with a nominee to the Selection Panel and the Sponsor by the closure of the nomination period in the same year of which they have been appointed to the Selection Panel.

(b) Any person on the Selection Panel who has disclosed any affiliation to a nominee(s), will be disqualified and their full voting rights revoked during the final selection of the award winners should that nominee(s) progress to be a finalist.

(c) The Sponsor reserves the right to appoint a replacement judge to the Selection Panel to avoid a conflict of interest arising during the final selection of the award winners. The selection made by the Sponsor is final and conclusive and no correspondence will be entered into after the selection has been made.

7. PRIZE

7.1. A prize will be given to the winner of the Award. The prize will include:

  • Title as ‘Australia’s Premmie Hero’ 2015
  • Accor Accommodation gift card (value of $500)
  • Two movie tickets to a cinema of choice
  • A uniquely designed trophy with winner’s name engraved
  • Beautiful jewellery piece donated by Sistaco
  • Story featured in an upcoming issue of Practical Parenting Magazine in 2016
  • Story featured on the L’il Aussie Prems Foundation website and social media pages
  • A lovely framed certificate

7.2. A prize will be given to the first runner up of the Award. The prize will include:

  • Accor Accommodation gift card (value of $250)
  • Two movie tickets to a cinema of choice
  • Beautiful jewellery piece donated by Sistaco
  • A uniquely designed medal with the 1st runner up’s name engraved
  • Story featured on the L’il Aussie Prems Foundation website and social media pages
  • A lovely framed certificate

7.3. A prize will be given to the second runner up of the Award. The prize will include:

  • Accor Accommodation gift card (value of $150)
  • Two movie tickets to a cinema of choice
  • Beautiful jewellery piece donated by Sistaco
  • A uniquely designed medal with the 2nd runner up’s name engraved
  • Story featured on the L’il Aussie Prems Foundation website and social media pages
  • A lovely framed certificate

7.4. The prize must be taken as offered.

7.5. If the prizes remain unclaimed after a period of 30 days after the date of notification of the winner, the prizes may be forfeited.

7.6. Photographic identification of the winner will be required (examples include drivers licence/passport/student card where photo included) to claim the prize. In special situations, and subject to the absolute discretion of the Selection Panel, a winner up may nominate a designated representative to collect the prize. The representative will be required to present written authorisation from the winner and photographic identification of both the winner and their representative. Photographs will not be returned.

7.7. The winner, first and second runner up, nominee and nominator agrees to undertake all reasonable media and promotional activities as directed by the Sponsor. In accepting these terms and conditions, you accept that you may be filmed and photographed and may be required to undertake television, radio, print and/or online media interviews and appearances and that those films, photographs and/or interviews may be in all forms of media, including but not limited to, television, radio, print and other media.

(a) Where the winner, first and second runner up have received multiple nominations in the nomination period as stated in these terms and conditions, the Sponsor reserves the right to decide if each nominator undertakes all reasonable media and promotional activities with the winner of an award. The decision made by the Sponsor is final and conclusive and no correspondence will be entered into after the decision has been made.

8. NOTIFICATION OF WINNERS

8.1. It is anticipated that the winner will be notified by telephone.

8.2. The Award winners will be officially announced on the L’il Aussie Prems Foundation website in October 2015.

9. ENTRIES

9.1. All entries become the property of the Sponsor and Selection Panel.

9.2. Entries not completed in accordance with the Terms & Conditions of Entry or received after the closing date will not be considered.

9.3. Indecipherable or incomplete entries will be disregarded.

9.4. No responsibility is taken for late or misdirected email.

10. RESERVATION

10.1 The Selection Panel reserves the right to nominate an appropriate candidate who has not been nominated through the nomination process.

11. PRIVACY & CONFIDENTIALITY

11.1. The Selection Panel is an independent panel of representatives from the community and they undertake to maintain confidentiality of all applicants and nominees prior to participating in the judging process.

11.2. The personal information collected as part of the entry is collected to enable identification of the winner and for future marketing and promotional purposes. Such information will only be disclosed to the Selection Panel and the Sponsor for these purposes of judging the Award.

11.3. Applicants and nominees may contact the Sponsor and/or Selection Panel if they would like details of the personal information that the Selection Panel may hold about the applicant or nominee or if they would like it to be corrected.

12. LIMITATION OF LIABILITY

12.1. Except for any liability that cannot be excluded by law, the Sponsor (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition, including, but not limited to, where arising out of the following:

(a)  any technical difficulties or equipment malfunction (whether or not under the Sponsor’s control);

(b)  any theft, unauthorised access or third party interference;

(c)  any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Selection Panel) due to any reason beyond the reasonable control of the Selection Panel;

(d)  any variation in prize value to that stated in these Terms & Conditions of Entry;

(e)  any tax liability incurred by a winner or entrant; and/or

(f)   redemption of the prize.

12.2. If for any reason the competition does not run for its duration due to a computer virus, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Sponsor or the Selection Panel that corrupts or affects the administration, security, fairness, integrity or proper conduct of the competition, the Sponsor and/or the Selection Panel reserve the right in their sole discretion to cancel, terminate, modify or suspend the competition or disqualify any individual who tampers with the entry process.

13. INTERPRETATION

13.1 In these Terms & Conditions of Entry, subject to any express or implied contrary intention:

13.1.1 reference to a party includes a reference to its personal representatives, successors and assigns;

13.1.2 words importing the singular include the plural and vice versa;

13.1.3 words importing any gender include every gender; and

13.1.4 clause headings are inserted for convenience of reference only and do not affect the interpretation or construction of this agreement.

13.1. These Terms & Conditions of Entry shall be governed and construed in accordance with the laws of Victoria.

14. GOVERNING LAW

14.1. These Terms & Conditions of Entry are governed by the laws of Victoria, Australia.

14.2. If any part of these Terms & Conditions of Entry is found to be invalid or unenforceable, it shall be severed to the extent possible without affecting the remainder.

15. INDEPENDENT LEGAL ADVICE

15.1. You agree that you have obtained independent legal advice for any conditions which you do not fully understand.
